多次性分家研究－－湖北省團風縣長林咀村有關分家的民事習慣調查報告

筆者通過實地調查發現，基於減輕家庭生活負擔、緩和家庭矛盾或對習俗認同等原因，湖北省團風縣長林咀村普遍採用多次性分家的做法。以此為出發點，本文詳細地描述了該分家析產模式的整體概貌，並深入探討了分家所涉及的析產、贍養、未婚弟妹的安排等主要內容。其中，重點論述了分家和析產的關系、可分財產的性質和範圍、析產的原則及其可能與實際運作存在衝突等相關問題。此外，本文對分家糾紛的解決也作了簡要介紹。

It has been found from a series of field investigations that the practice of dividing up a family more than once is very common in Changlinzui Village, Tuanfeng County, Hubei Province. From such a starting point, the author makes a detailed description of the general mode of such family division and property distribution, including property distribution, support for the aged, and arrangements for the unmarried brothers or sisters in family division. And the author analyzes the relationship between family division and property distribution, the nature and scope of divisible property, the principles of property distribution, and the conflicts that may exist between the principles and actual operations, as well as the settlement of family dividing disputes.
