民事習慣對民法典的意義－－以分家析產習慣為線索

分家是古代中國調整家產傳承關系的重要習慣之一，這一習慣已經有兩千多年的歷史。調查證明，這一習慣仍然支配著中國農村家庭的家產傳承行為。該習慣的基本特點是，家長在生前將家產按親子的數量平均分割後，交付於各親子。我國現行《繼承法》至今仍無視這種習慣的存在。民法典編纂在即，如何利用西方法律概念、方法和理論框架對分家及各種民事習慣進行學理分析，是中國民法學無法回避的任務。

In the ancient China, family-division, which has already lasted over 2000 years, is one of the most important usages regulating the family property. It is verified by our investigation that this usage still dominates the rural family possessions in China. The fundamental characteristic of this usage is that parents hand over the family property to every parents-offspring before death, divided equally according to the quantity of their sons. However, the current succession law disregards the existence of the usage so far. During the drafting of the Civil Code of the People’s Republic of China, it is inevitable mission for China civil law academic studies to judge how to academically analyze all kinds of civil customs via concepts, methods and theoretical frames of Western law.
