不動產物權衝突研究

本文依循一種從衝突到解決衝突到尋求司法方法論的思路，綜合運用了法歷史研究、規範比較、類型化研究、法律解釋學等手段，對選取的幾種不動產衝突模型進行了規範分析和價值分析，力求發現解決不動產物權衝突的一般性規則、原則以及司法方法論。論文共分7 章20節，包括序論和結語部分。

Defining the essence of real estate property right conflicts, this paper strives to find both general and universal rules in solving right conflicts and to provide a theoretical background for the Settlement of the conflicts. The article begins with the rule of the formation of property right conflicts, then points out how to settle the conflicts, and finally explores judicial methodology. It employs a combination of methods such as the historical method of investigation, norm comparison study, genre research and interpretion study, etc. The paper is divided into seven chapters, including an introduction and an epilogue.
