本文首先藉由問題背景強調學校體育政策合法化之必要性與重要性。次論,政策合法化之理論基礎,包括:政策合法化之意義、政策合法化的參與者及政策合法化的程序;其中在政策合法化程序方面,包括:提案、一讀會、審查、二讀會、三讀及公布等六個階段。再者,探究學校體育政策合法化過程及其影響因素,其中在政策合法化過程中包括:學校體育政策合法化法令擬定(或修正)過程及法令審查過程;另外在影響因素方面包括:掌握政策方向的行政機關人員;提供諮詢及擬定草案的學者專家;提供意見的民意代表、民間團體及大眾。此外,針對現行十一種學校體育重要法令作內涵引介,且經由過去,現在及未來三個時間面向作深入探討分析後建構學校體育法制構想圖。最後,在結論部分則提出學校體育政策之推動,藉由學校體育法令之有關規定,並透過學校體育各中程計畫之落實,均係屬學校體育政策合法化的範疇,其與「學校體育法」的立法具有相輔相成的效果,也端賴中央主管教育行政機關及體育從業人員之共同努力方能克竟全功。In this essay first of all we rely on the background of the problem to emphasize the necessity and importance of school physical education policy legalization. The second point is based on the theory of policy legalization which consists of the meaning of policy legalization, the participants involved in the policy legalization, and the procedures involved in the policy legalization. The procedures involved in policy legalization consist of six stages. These are raising a proposal, the first reading, revision, the second reading, the third reading and an announcement. Furthermore, a thorough inquiry will be made into the course of the school physical education policy legalization and other influencing factors. The course of the policy legalization consists of the process of drafting (or amending) school physical education policy legalization, and the process of reviewing the decree. Other influencing factors include the control of policy direction by personnel in the Administrative Authority, the provision of specialist academics for consultation and for drafting plans; and the provision of legislators, organizations and citizens, giving them a platform on which to state their opinions. Besides, focus will be placed on the full connotations of the 11 current important school physical education laws. Then following a thorough analysis of the past, present and future directions of the laws, a blueprint will be created for a school physical education legal system. Finally the concluding part advances the promotion of the school physical education policy, relying on the related rules of the school physical education laws; and a practicable mid-term plan for every school's physical education. The just mentioned points belong to the category of the school physical education policy legalization. The legalization and the School Physical Education Laws legislation possess complementary results. In addition, to successfully accomplish this task, there will be a heavy reliance on the joint effort of those in charge of the Educational Administrative Authority and those involved in physical education.
