Comments on Professor Harten's Sense of Crisis on Sino-Canada BIT

中加雙邊投資條約是中國迄今為止締結的內容最為廣泛的一個雙邊投資條約，並在重大問題上反映了國際投資協定的新發展和新趨勢。加拿大哈頓教授中加雙邊投資條約所作的評論，充分體現了他極強的法律意識，是一種敢於向聯邦政府諫言的「書生」精神，更是一種憂國憂民的懮患意識和愛國情懷。本文對哈屯教授的憂患意識進行梳理，並對中國以往簽訂的部分雙邊投資條約進行反思和借鑑，最後以中國海洋石油總公司收購加拿大尼克森公司案為視角，剖析哈頓教授憂患意識的局限性，批評加拿大某些政黨、媒體的不當言論，指出：不要因為害怕中國大規模向加拿大投資的互利共贏行動，就不分青紅皂白地喊「狼來了」。The Sino-Canada Bilateral Investment Treaty is the most extensive bilateral investment agreement signed by China so far, and reflects the new development trend of international investment agreement. The comments on the Sino-Canada Bilateral Investment Treaty by Canadian Professor Harten have fully reflected his strong legal consciousness, his spirit of advising the Federal Government on Sino-Canada Bilateral Investment Treaty and also the sense of crisis and patriotic feelings. This article summarizes the sense of risks on Sino-Canada Bilateral Investment Treaty of Professor Harten, rethinks China's previous Bilateral Investment Treaties and draws on the experiences of Canada. Finally, from the perspective of CNOOC-Nexen deal, the limitations of the sense of risks are analyzed. The conclusion tries to clarify that both CNOOC-Nexen and Sino-Canada Bilateral Investment Treaty are useful to the two countries.
