日本法律近代化研究及其對中國的啟示

THE SPIRITUAL MTIVATION OF JAPANESE LEGAL MODERNIZATION

本文通過對日本民族的倫理價值體系及占據其核心地位的名譽觀的考察，發現其獨特的倫理道德成為日本人在近代完成法律轉型的重要精神動力因素。對名譽觀念的重視是日本人不甘心落后的人生目標，其所依托的倫理道德”由”義務”、”義理”兩大類規落組成，它們構成了日本人生活的主要道德規范。名譽觀的實現方式深化了日本民族對名譽觀念的重視，其兩個衛生物現世主義和對教育的重視促進了日本法律在近代的轉型。本文從精神層面的探究僅僅是種研究的嘗試，以期對中國的法治進程有所裨益，並不意味著否認其他因素在日本社會法律轉型中的重要作用。

Through probing into an ethical value system whose core is the honorable value of the Japanese notion, this article discovers that unique ethical values become important spiritual factors in the completion of legal transformation in our modern era. Paying attention to the honorable value is a Japanese goal in life which is unwilling to lag behind other people.
