中國刑法下二元化犯罪模式之法理審視

犯罪模式的選擇過程及其難點之一，就是如何妥善處理好犯罪化與非犯罪化兩者之間的關係，尋找它們之間的最佳平衡點。二元化犯罪模式在中國並非一個簡單的刑法問題，而是具有獨特價值的法理問題。對此”問題”認知過程中產生的法理分析既影響到有關犯罪標準的制定，又反過來形成了犯罪標准的理想模型，因此，應從激勵、效能、謙抑等方面全方位審視一犯罪模式，實現該犯罪模式從危機到契機的轉化，並應警惕該犯罪模式帶來的羊群效應。

To talk about the selection process of criminal patterns as well as difficult points in it, we must first address how to properly deal with the relationship between crime and non－crime, and find out the optimal balance point between the two. Dual crime patterns are not simple penal questions in China, but are a legal principle of unique value. Legal analysis generated during the cognitive process in response to this question will impact the waking of the relevant criminal standard, and it in turn forms an ideal model for a criminal standard. Therefore, we should see this criminal pattern comprehensively from the perspective of stimulation, efficacy, and modesty, and realize the change of criminal patterns from crisis to opportunity, and be alert to the Herd Instinct caused by such criminal patterns.
