This article, entitled The Constitutional Court as an“Integration Court”, explores the concept and meaning of integration in relation to the Constitution, the constitutional interpretations, and the Constitutional Court. This article examines the integration task, integration model, and integration function of the Constitutional Court, demonstrating its role as an integration court. The integration carried out by the Constitutional Court aims to resolve differences in constitutional disputes by balancing multiple values and coordinating power conflicts through constitutional dialogue in accordance with the relevant procedures of the Constitutional Court Procedure Act. Subsequently, the Constitutional Court, in accordance with the“basic consensus”(constitutional norm) established by the Constitution, seeks to find a“consensus”(constitutional interpretation) amid constitutional differences. First, this article discusses the meaning of integration in the Constitution and elucidates the constitutional court procedure as an integration procedure according to the relevant provisions of the Constitutional Court Procedure Act, arguing that the Constitutional Court undertakes integration tasks based on the constitutional norms. Second, this article explores how the Constitutional Court, according to different types of constitutional litigation, employs different operating models of judicial review (integration models) for constitutional cases concerning integration tasks. Therefore, this article classifies integration functions derived from the integrated constitutional interpretations, including the mutual influence of fundamental rights and the dynamic balance within separation of powers in order to justify the Constitutional Court as an integration court, thereby earning the trust of the people in its constitutional interpretations. To this end, this article, in accordance with the Constitution, the Constitutional Court Procedure Act, and the practice of constitutional interpretations, delineates the integration task, integration model, and integration function of the Constitutional Court. This article examines the legality, typology, and legitimacy of the Constitutional Court’s constitutional interpretation undertaken in the name of integration, ultimately demonstrating that the Constitutional Court serves as an integration court.
