Administrative contracts are institutional instruments that emphasize authorities fulfilling statutory mandates by reaching agreements, as implied by their term. Its function and importance are not inferior to an administrative act. This research aims to delve into the regulatory functions of the administrative contract within the administrative law system. It starts with an analysis of the statute law (the Regulations of the Administrative Procedure Act) to deconstruct conceptual elements and normative content, outlining the features of the institution. Throughout this process, the research highlights that the core of the administrative contract lies in its normative feature, namely“legal relationships under public law”. Subsequently, from the perspectives of administrative material law and administrative procedural law, this research determines the boundaries of the administrative contract, particularly focusing on the relationship between the administrative act and the administrative contract. It is hoped that this essay will contribute to advancing administrative law, thus constructing the entire picture of the legal relationship of the administrative contract. |
