This article focuses on the recent revision of Japanese Penal Code concerning regulations on sexual intercourse made by guardians, and the revision of the age of consent for the crime of sexual intercourse with consent of a minor. In addition to introducing the various theoretical positions in the field of Japanese criminal law on these revisions, it provides an interesting explanation with reference to recent trends in German criminal law. Furthermore, from a substantive point of view, this article suggests the healthy growth of children can be the base shared by the crimes mentioned in this article. |
