論香港基本法共識的憲法社會學建構：意義、策略與機制

Taking Constitutional Sociology as a Method for Consensus on the Basic Law of Hong Kong：Meaning Construction, Action Strategies and Assurance Mechanisms

基本法共識是香港基本法有效實施的重要社會基礎，是“一國兩制”和香港保持長期繁榮穩定的重要保障。凝聚基本法共識作爲基本法實施的“高級目標”越來越凸顯，推進香港社會的“人心回歸”。對基本法共識的研究，應進入基本法研究的視野之中，本文試圖結合憲法社會學的研究方法與香港的“一國兩制”的憲制秩序，提出凝聚基本法社會共識的理論框架，並從研究旨趣上，試圖擴展香港基本法研究理論視野和中國憲法社會學的研究路徑。本文著眼於基本法共識的社會建構視角，探究香港基本法在社會層面進行意義建構、行動策略、機制保障的進程，意義建構包括價值建構、規範建構和表達建構等方面，行動策略包括教育、傳媒和組織動員等方式，機制保障包括組織協調、威懾、激勵、監督等機制，同時，基本法共識的意義建構、行動策略、機制保障三者之間存在著緊密的互動關係，並實現從基本法文本到基本法共識的路徑。

Consensus on the Basic Law is an important social foundation for the effective implementation of the Basic Law, and an important guarantee for "one country, two systems" and the long-term prosperity and stability of Hong Kong. Consolidating consensus on the Basic Law as the "high-level goal" of the implementation of the Basic Law is becoming more and more prominent, and promotes the "return of people’s hearts" in Hong Kong society. The research on the consensus of the Basic Law should be brought into the field of study of the Basic Law. This paper attempts to combine the research methods of constitutional sociology with the constitutional order of "one country, two systems" in Hong Kong, and propose a theoretical framework for condensing the social consensus of the Basic Law in Hong Kong , trying to expand the theoretical horizons of Hong Kong Basic Law research and the research path of Chinese constitutional sociology. This paper focuses on the social construction perspective of the consensus of the Basic Law, and explores the process of meaning construction, action strategies, and mechanism protection of the Hong Kong Basic Law at the social level. Meaning construction includes value construction, norm construction, and expression construction. Action strategies include education, media, and organizations. Mobilization and other means, the mechanism guarantee includes organizational coordination, deterrence, incentive, supervision and other mechanisms. At the same time, there is a close interaction between the meaning construction, action strategy, and mechanism guarantee of the Basic Law consensus, and realize the basic law text to the basic law consensus.
