Immigration law has always been in the peripheral area of legal research and practice. Issues related to transnational marriages and families have rarely received the attention from judicial practice and legal research. In particular, the border control measures reinforced under the influence of the COVID-19 are viewed as the only effective measure to prevent the spread of COVID-19. Furthermore, under the influence of the national preference and ethnic bias towards different nations, the family reunion with foreign national or Mainland China spouses and children becomes more and more complicated and difficult. This article serves as a reminder that issues related to immigration are not unregulated in that the Immigration Act must comply with the principle of rule of law. |
