The Political Process of the Mental Health Law in Taiwan — The Policy-Centered Perspective

本文採政體中心的觀點，分析精神衛生法立法過程中，國家與各種社會力量互動的結果，如何影響該法案的產出；並凸顯國家結構性的限制和官僚體系的特殊偏好，如何成為決定性的因素，影響該法的立法結果。研究者採歷史分析法，指出台灣過去的政策經驗的遺跡與國家政體的變遷，如何限制了該法審議過程中特定專家的意見，與市民的低度參與。文中並指出立法過程中，若干爭議性的條文，並分析其如何獲致最後的立法結果。

This research uses the polity-centered perspective to analyze the political process behind the enactment of the Mental Health Law(MHL) in Taiwan. It focuses on how the interaction between state and civil society influences legal outcomes. The researcher points out that the state structure and the preferences of government bureaucrats were decisive factors in the initiation of the MHL. The historical analysis also shows how Taiwan's political and policy legacy has limited the depth and breadth of the MHL.
