On May 28, 2024, the Legislative Yuan passed the third reading of Law Governing the Legislative Yuan`s Power, which added and amended some articles, many of which have caused controversy between the government and the opposition. On June 6, with the approval of the President, the Executive Yuan referred the disputed provisions to the Legislative Yuan for reconsideration. However, opposition parties took advantage of their numerical advantage to veto the motion by 62 to 51. After the bill was promulgated and came into effect on June 24, the ruling party, including the president, the Executive Yuan, 51 legislators including Ker Chien-Ming, and the Control Yuan, immediately requested a ruling from the Constitutional Court on the controversial provisions. The Constitutional Court delivered Judgment 113-Hsien-Pan-9 on October 25, 2024. This roundtable forum was held by five constitutional scholars from the political science community to discuss several controversial topics. These include the controversy over the system of the president reporting on the state of the nation to the Legislative Yuan, the constitutional significance of questioning and the issue of counter-questioning, the scope and punishment of contempt of Congress, and the exercise of the right to consent to personnel appointments, the right to investigate, and the right to hold hearings. We hope this discussion will inspire interest in these issues. |
