修復式正義運用於少年輔導委員會案件之研究──澳洲塔斯馬尼亞州經驗

A Study of Applying Restorative Justice in Youth Counselling Committee−Experiences from Tasmania, Australia

有鑑於少年輔導委員會新制於2023年7月1日正式上路，承擔起曝險少年行政先行之重任，如何精進少年輔導委員會對曝險少年之輔導與非行預防，以及整合多元資源，乃當務之急。「修復式正義」作為協助少年健全發展的一條路徑，在國際上已獲諸多正面評價，如修復當事人間情感傷害，以及重建與強化當事人與家庭、社區間的關係等，並於2019年正式納入我國少年事件處理法，作為少年事件繫屬於少年法院後之案件處理選擇。然而，在規劃曝險少年轉向行政先行之際，卻鮮少有行政部門如何運用「修復式正義」協助少年再整合（reintegration）之討論。
為補足此一研究與實務上之缺口，本研究綜合分析比較我國脈絡，及澳洲塔斯馬尼亞州早期介入及少年行為小組（Early Intervention and Youth Action Unit，當地警察機關內類似我國少年輔導委員會之單位）整合運用修復式正義於少年事件逾二十年之經驗，供我國發展相關政策與操作模式之參考，並於文末提出少年輔導委員會輔導工作暨修復式正義流程圖，以協助少年輔導委員會建構具修復性的工作方法，並將修復式正義緊密結合於少年支持方案中。

Following the 2019 revision of the Juvenile Justice Act, the Youth Counselling Committee (YCC) was empowered to play a prioritised role in working with at-risk youth in Taiwan, with implementation beginning in July 2023. While restorative justice (RJ) has gained international recognition for its potential in healing emotional harm, rebuilding family relationships, and strengthening community connections, and despite its inclusion in Taiwan’s 2019 Juvenile Justice Act, it rarely appears in discussions of administrative interventions by the YCC.
To address this research and practical gap, this research examines the potential integration of RJ into Taiwan’s YCC framework by drawing from the experiences of Tasmania, Australia (Early Intervention and Youth Action Unit), where RJ has been implemented in juvenile cases within the police department for over two decades. Through analysing Tasmania’s experience with Taiwan’s YCC context, this research proposes policy recommendations and operational models, including a workflow diagram integrating RJ into YCC’s counselling work tailored to Taiwan’s context. This framework aims to support YCC build their work in a restorative way and closely integrate RJ into supporting programmes.
