談美國大學電台利用音樂與錄音著作之授權計費機制

Study on the Licensing and Fee Calculation Mechanism for the Use of Musical Works and Sound Recordings by College Radio Stations in the U.S.

大學電台自20世紀初起即在美國高等教育中扮演著重要之角色，具有高度之公益特質，這些電台不僅傳達娛樂與教育等資訊，還為學生提供培養專業知識、技能與實習之平台，並且為師生累積社區參與服務珍貴經驗之場域。然而，隨著科技與文化之發展，以及數位音樂與網路傳播技術之普及，大學電台於運營過程中面臨越發複雜之著作權問題，尤其涉及音樂與錄音著作公開演出權之授權費用計算更是重中之重。然而，我國於大學電台利用音樂與錄音著作方面，因著作財產權之型態細分導致授權流程複雜，且於授權費率方面欠缺具體計算機制與對教育機構之特別支持。美國《著作權法》，相對地對音樂著作與錄音著作之公開演播權及重製權有著詳細之規範，並且於聯邦法規制定大學電台相應之授權金費率計算方法，於探討大學電台利用音樂與錄音著作之授權計費機制時，美國之相關制度應具高度參考價值。本文旨在學習美國經驗，欲以介紹美國大學電台之歷史與運營結構出發，進一步介紹美國著作權之基本概念、大學電台利用歌曲所涉之著作型態與權利類型、以及《著作權法》之授權金計算規定。本文接著將聚焦於大學電台利用音樂著作與錄音著作之授權費率計算實務，包含美國聯邦法規之法定計算方法，及其他約定計算方式。最後，本文擬藉由美國以上關於大學電台利用歌曲之授權計費機制，檢視並反省我國大學電台之相關計費制度，進而提出建議。

When exploring the licensing and fee calculation mechanisms for the use of musical works and sound recordings by college radio stations, the U.S. system offers highly valuable insights. This article aims to learn from the U.S. experience, beginning with an overview of the history and operational structure of U.S. college radio stations. The article will then introduce the basic concepts of U.S. copyright law, the types of copyrighted works and rights involved in the use of songs by college radio stations, and the statutory royalty calculation provisions in the Copyright Act. The focus will then shift to the practical aspects of royalty fee calculation for the use of musical works and sound recordings by college radio stations, including the statutory methods outlined in the Code of Federal Regulations, as well as other negotiated methods. Finally, this article seeks to reflect on and evaluate the college radio fee calculation system in Taiwan based on the U.S. mechanisms, and offer suggestions for improvement.
