As the advancement of deep learning technology, artificial intelligence can replace human creation to generate text, audio, video, images, etc. In the future, art, literature, or music creations may all be produced by artificial intelligence.“Copyright and Artificial Intelligence”published by the U.S. Copyright Office concludes that the results produced by AI can only be protected by copyright when the human author clearly provides sufficient expression requirements. This covers situations where the AI output process is detectable as a work created by humans, or where human authors make creative arrangements or modifications to the output work, rather than just giving the AI prompts. This article focuses on exploring whether the works of generative AI meet the requirements for copyright protection. The protection of generative AI should still focus on the creative input of human spirit. AI-generated works are not protected. Regarding the interpretation of the idea-expression distinction, especially for the use of generative AI to imitate artistic style, it should be considered that the speed and convenience of AI creation are still incomparable to traditional human authors. Therefore, further consideration can be given to how to provide more protection for the original creators. |
