中國區域國別法學自主知識體系的建構

On the Construction of China's Self-independent Knowledge System of Area and Country Legal Study

區域國別法學是以特定國家和地區的法律為主要研究對象，服務於國家涉外法治建設，具有交叉學科屬性的一門新興法學學科。該學科的自主知識體系建構是優化法學學科體系、健全法學教育體系的重要內容。發展中國特色的區域國別法學既需要把握該學科發展的歷史脈絡，還需要認識該學科在新時代下的當代價值。區域國別法學的學術體系既要借鑒法學等相鄰學科的理論基礎，也要根植於中國優秀的法律傳統文化。區域國別法學的學科體系要以問題為導向，以交叉學科的理念打破傳統學科之間的壁壘，優化課程設置。區域國別法學的話語體系要以中國特色社會主義思想為指導，秉持平等、互鑒、對話、包容的文明觀，圍繞國際團結、和平共處五項原則和人類命運共同體思想進行構建。中國區域國別法學三大體系是一個有機的統一體，彼此相互支撐、相互促進。中國區域國別法學要有新時代的使命和擔當，立足於中國，放眼世界，為世界法律文化的交流互鑒作出貢獻。

Area and country legal study is a new legal discipline with cross-disciplinary attributes, which mainly studies the laws of specific countries and regions and serves the construction of foreign rule of law in the county. The construction of the subject's independent knowledge system is an important content of optimizing the subject system of law and perfecting the legal education system. The development of area and country legal study in China needs not only to grasp the historical context of the development of the discipline, but also to understand the contemporary value of the discipline in the new era. The academic system of area and country legal study should not only draw on the theoretical basis of adjacent disciplines such as law, but also be rooted in China's excellent traditional legal culture. The discipline system of area and country legal study should be problem-oriented and break the barriers between traditional disciplines with the idea of cross-discipline. The discourse system of area and country legal study should be guided by the Thought of Socialism with Chinese characteristics, implement the concept of a community with a shared future for mankind, and uphold the concept of equality, mutual learning, dialogue and inclusiveness, and build around the principle of international solidarity, the five principles of peaceful coexistence and the idea of a community with a shared future for mankind. The three major systems of regional and national law in China are an organic unity, which support and promote each other. China's area and country legal study should have the mission and responsibility of the new era, be based on China, look at world, and contribute to the exchange and mutual learning of legal culture in the world.
