少輔會處理曝險少年行政輔導先行之問題與未來展望──以日本兒童相談所為借鏡

Problems of Juvenile Counseling Committee in Taiwan and the Future of Adopting Policies from Japanese Child Counseling Center

少年事件處理法（簡稱：本法）於1962年公布實施至現在，已有多次重大修正軌跡，例如1997年朝福利概念進行修正、2019年行政輔導先行、2023年強制處分制定等。本論文聚焦在2019年6月修法2023年7月1日實施之少年輔導委員會（簡稱：少輔會）「行政輔導先行」實施後，對於曝險少年進行輔導少輔會的實際輔導實施狀況與問題。本文採文獻探討與比較法研究，著重於本法在承襲日本少年法制定後朝向本土化重要的轉折，以及對於類同我國少輔會功能的日本兒童相談所功能的探討。本論文的目的除了釐清少輔會在2023年7月1日實施後所發生之問題外，並針對少輔會與日本兒童相談所之功能進行對照，其目的在於對於未來少輔會是否可轉型部分類同日本兒童相談所之網絡連結功能進行探討。

Since its implementation in 1962, the Juvenile Delinquency Act has undergone several significant amendments. This paper focuses on the current counseling situations and problems of the Juvenile Counseling Committee following the implementation of the“Administrative Counseling First”, which will take effect on July 1, 2023, after the law was amended in June 2019, and the actual counseling needs of at-risk juveniles. This paper adopts a literature review and comparative methodology to clarify the problems that arose after the implementation of the Juvenile Counseling Committee on July 1, 2023, and to explore whether the Juvenile Counseling Committee can be transformed into a multifunctional organization akin to the Child Counseling Center in Japan in the future.
