Currently, there are quite a few countries in the world that have issued a separate law regulating administrative violations and sanctions for administrative violations. Vietnam is one of the few countries that have issued a separate law regulating the issue of sanctioning administrative violations. According to Vietnamese law, administrative violations and criminal violations have a dialectical relationship but also have certain differences. The main difference between administrative violations and criminal violations is that the degree of danger to society of crimes is higher than that of administrative violations. Criminal violations are specified in the 2015 Criminal Code (amended and supplemented in 2017). Meanwhile, administrative violations are specified in the decree sanctioning administrative violations of the Government. This article analyzes the differences as well as the relationship between administrative violations and criminal violations, highlights legal inadequacies, and proposes a complete solution. |
