試析國際投資法下「國內訴訟先行」之程序規定得否由仲裁庭認定－－以BG Group Plc v. Argentina案為中心

2003年4月25日，英國公司BG Group Plc.（以下簡稱BG Group）依據英國政府與阿根廷政府的雙邊投資協定（Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Argentina for the Promotion and Protection of Investments of 11 December 1990，下簡稱雙邊投資協定）以美國華盛頓特區為仲裁地對阿根廷政府提出仲裁，主張其在阿根廷的投資受到阿根廷政府的侵害，請求阿根廷政府賠償其損失，仲裁庭認定阿根廷政府須以金錢賠償予BG Group。
