On Fact-finding in Death Penalty Cases

本文探討死刑案件的事實認定，認為應採取嚴格正當法律程序，對於犯罪事實需要達到無殘存的懷疑程度，方有適用死刑的可能。關於事實認定的論證部分，應該從公正事實觀出發，以無罪推定等原則為規範，以程序理性的方式探究事實，並結合論據模式與故事模式，論證證據與事實之間的關係。裁判者在自由心證的部分可以從這樣的觀點來說明和論理，特別是當對於證據的論據或整體故事，有另外一種可能性存在時，裁判者應該詳細說明駁倒另外一種可能性，形成其確信。最後以此觀點，檢視連國文的共謀共同正犯相關的證據說理。

In this article, we propose that courts should never apply the death penalty until there is certainty that the defendant is guilty. In other words, when exploring the facts of a criminal case where capital punishment is an option, courts should always presume the innocence of the defendant until overwhelming evidence of guilt is established. We explore this basic legal concept in the context of the Guo-Wen Lian case.
