This article is an analysis report commissioned by the Taiwan Alliance to End the Death Penalty, evaluating whether the criminal guilty verdict received by Guowen Lian was wrongful or not. Guowen Lian was involved in two criminal guilty verdicts related to murder incidents that occurred on March 26 and March 31, 2000. This report is an analysis specifically focusing on the Guanren Wang case within those incidents. According to the principle of free evaluation of evidence, the court has discretion in determining the facts and evaluating the evidentiary strength. However, the principle of free evaluation of evidence should not be understood as unrestricted discretion for the court. This article argues that several basic principles established and recognized in criminal procedure law collectively form the criteria for judging the legality of a judge’s (free) evaluation of evidence. This report is an analysis conducted within this systematic framework of regulations. |
