試論著名商標之國際保護（二）

歐盟（European Union）對於商標法律制度，係先行制定商標指令（First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks, Trade Mark Directive），用以協調其會員國各別制定內國商標註冊制度。迨至1993年歐盟復公布商標規則（Council Regulation 40/94 of Dec.20, 1993, On the Community Trade Mark, as amended by Council Regulation(EC) No. 3288/94 of 22 December 1994 for the Implementation of the Agreements Concluded in the Framework of the Uruguay Round）（CTMR），建立獨立完整之歐盟商標（Community trade mark）註冊制度，由OHIM（Office for Harmonization of the Internal Market）負責管理商標之註冊與異議事宜。
