多元調解的平臺機制:制度創新、技術賦能與組織迭代

The Platform Mechanism of Multiple Mediation: Institutional Innovation, Technological Empowerment and Organizational Iteration

多元调解的平台化是新时代“大调解”工作的主要趋势。重庆合川、荣昌两地的示范经验表明，多元调解平台既不是政策响应的“在线”技术架构，也不是在线纠纷解决（ODR）的特殊模块单元，而是涵摄以“多元共治”为目标的调解制度创新、以“多元协同”为目标的调解组织再造和以“多元交互”为目标的调解技术赋能的复杂有机系统。通过“制度➝组织➝技术➝组织”的内在机制重构，平台自身趋向演化为吸纳不同调解类型、整合各类调解资源、协调多元调解体系、衔接其他解纷形式的“多元一体”的智慧调解组织，是中国式社会治理现代化的标志性成果。多元调解平台的应用推广，需要进一步优化平台机制，在制度上，制定有关多元调解的专门法律，明确以人民调解为基础的调解主体权责分配与协同配合机制、程序节点重制与场景嵌入规则；在技术上，规范格式标准、统一数据接口，尽快实现内外贯通可信协同、调解知识图谱构建与智能推理、矛盾调解过程要素抓取理解及趋势分析等关键技术的实质性突破。

The platformization of multiple mediation is the main trend of“multipatite mediation”in the new era. The demonstration experience of He Chuan & Rong Chang in Chongqing shows that the multiple mediation platform is neither an“online”technical framework for policy response nor a special module unit of ODR, but a complex organic system that embraces mediation system innovation with the goal of pluralistic co-governance, mediation organization re-engineering with the goal of pluralistic collaboration, and mediation technology empowerment with the goal of pluralistic interaction. Through the internal mechanism restructuring of the“System➝Organization➝Technology➝Organization”mode, the platform itself tends to evolve into a smart mediation organization that absorbs different mediation types, integrating various mediation resources, coordinating multiple mediation systems, and connecting other forms of dispute resolution. Matrix coordination, modular operation, and“multiple integration”can effectively meet the social needs of multiple dispute resolution and the governance needs of multiple coordination. It is an important innovation of“governance of China”in the digital era. The application and promotion of the multi-mediation platform need to further optimize the platform mechanism. In terms of the system, the Multi-Mediation Law should be formulated to clarify the mechanism of power and responsibility allocation and coordination of mediation subjects based on people’s mediation, the rules of program node reestablishment and scenario embedding; In terms of technology, through standardizing format standards and unifying data interfaces, we can achieve substantial breakthroughs in key technologies such as internal and external connection, trusted collaboration, mediation knowledge map construction and intelligent reasoning, grasping and understanding of key elements of the mediation process, and trend analysis as soon as possible.
