Since the late twentieth century, the digital convergence has blurred the inherent boundaries between the communications and media industry along with the crash to existing legal framework of Communication and crossownership regulation in many countries. Therefore, many countries started to review the existing legal framework, Taiwan also began to promote the continuous re-structure of the legal framework of communications after the MOD dispute of Chunghwa Telecom. This article aims to comprehend the disputes caused by digital convergence and resolution for it;hence it chooses“cross-ownership regulation”and“re-structinize the legal framework of Communications”as subjects, with using comparative method and taking IPTV as a media for observation, and will do following research:First, it will introduce the legislation for the IPTV in Taiwan, and then compare it to those in United States, European Union and Singapore. Second, it will compare different models of regulation for new services and adjustments to communication Act between these countries under the trend of digital convergence, and then analyze advantages and disadvantages of each model to explore the optimal one for Taiwan. Ultimately based on the results above, this article will conclude with concrete suggestion for the convergent legal framework of future communications in Taiwan, including the target of three stages(close, intermediate and distant targets)and its direction for implementation, which this article hopes to be beneficial for the construction of convergent legal framework of communications in Taiwan. |
