刑事訴訟中針對原住民身分的被告，有給予一定的積極性平權措施，也就是必須設置原住民專門法庭以及委任律師予以強制辯護，然而，這樣的司法給付是否真的發揮功能，還是徒具形式，尤其當檢視司法實務，會察覺大多的案件其實與原住民身分並沒有太大的相關，這樣的立法在面對平等原則檢驗下，可能會存有不同的思考。
