It is urgent to focus on the common interests of the international community under the increasing demand for the multilateralism-based international civil and commercial order, and the recognition and enforcement of civil and commercial judgments (REJ) need to be reviewed from the perspective of global governance. The global governance of civil and commercial disputes requires REJ in terms of balance of interests, judicial mutual trust and regulatory function. Actively responding to the above requirements on the REJ not only helps to integrate the opposition between the particularism private international law and the universalism private international law on the transnational movement of civil and commercial judgments, but also guides the normative innovation of the REJ. As far as the normative innovation of the REJ from the perspective of global governance is concerned, it is necessary to build a normative system that balances the common interests of the international community and national interests, create a normative system that promotes the institutionalization of judicial mutual trust, and establish public order norms with regulatory function, so as to provide institutional guarantees for China to promote the construction of a community with a shared future for mankind in the international civil and commercial fields. |
