As the COVID-19 pandemic erupted in 2022, governments worldwide have taken various public health measures that often infringe on human rights. Instead of focusing on the utilitarian or libertarian approaches that underpin Taiwan's pandemic response, the Article examines Taiwan's public health measures through the lens of the right to health: as currently, the jurisprudence on the right to health is underdeveloped. The Article refers to General Comment 14 as a starting point to investigate ways in which public health measures can help mitigate health inequalities as well as ensure the meaningful realization of the right to health-both mentally and psychologically. |
