On March 19, 2021, Professor Wang was invited by the Collegeof Law, National University of Kaohsiung to give a speech at itsInternational Conference Hall. By reviewing Professor Wang'sexperiences in studying and writing about civil law, he illustrated thedevelopment and contributions of civil law jurisprudence in Taiwanover the past fifty years.In his speech, Professor Wang shared several cases andSupreme Court decisions, describing his involvement in theformation and development of civil law through the process ofwriting “Research on the Theory and Precedents of Civil Law,” andthe interaction between theory and practice, as well as his use oflegal methodology to analyze Supreme Court decisions and constructa legal system.Professor Wang points out the importance of legal education and case study, and uses his experience in Germany studying civillaw to emphasize that it is vital for legal education in terms oftraining in the basis of a claim and thinking about its application oflaw.The development of jurisprudence lies in the reflection andprogress of legal methodology, and judges deal with cases and guidethe development of jurisprudence at the same time. Judges interpretand build the law further through court decisions, which initiates thedevelopment of laws and keeps them improving. Theories are givenlives by court decisions, and decisions are formed into rules orprinciples with the assistance of scholars. Through the synergy ofjurisprudence and theories, the fruits and creativity of our civil laware constructed.Professor Wang believes that the formation of legal principlesand the exploration of legal problems depends on the people whomeet them, and the process of law creation and formation iscontributed by the participation and efforts of many people. Heexpects that legal professionals should have this belief and find hisvocation to guide and build the law into progress. |
