The penalties for dangerous driving behaviors in Taiwan are mostly legislated in the Act Governing the Punishment of Violation of Road Traffic Regulations. In the Criminal law, driving under the influence of drink or drug is mainly regulated in Article 185-3, and the other dangerous driving behaviors like racing, going too fast, or driving aggressively etc., is understood as the behavior type of “using other similar means” in Article 185 with the judgements of the Taiwan Supreme Court. In some cases, a single offense that constitutes Article 185 and 185-3 is concurrently resulted in the penalties prescribed in Article 185. Therefore, this article aims to analyze the penalties for dangerous driving behaviors and application of the Criminal Law with reviewing the judgements of the Taiwan Supreme Court and theory. |
