日本運動競技賄賂罪之研究──兼論我國運動彩券發行條例相關規定之刑罰規定

A Study of Competitive Sports Bribery in Japan: Concurrent Analyses on the Penalties in Sports Lottery Issuance Act

本文主要透過考察日本對於運動競技賄賂行為之處罰的立法經驗，探討我國運動競技賄賂罪的立法可能性及必要性，認為依現行運動彩券發行條例（以下稱運彩條例）規定無法規範關於競賽或辦理運動彩券及競賽業務授受賄賂的行為，且考量我國立法制度及運動競技發展現況，增訂不涉及賭博的運動競技賄賂罪仍有爭議，故主張於運彩條例的架構下訂立運動競技賄賂罪，並參考日本體育振興投注實施等相關法律的立法模式，區分競賽賄賂罪及職務賄賂罪，以補充現行運彩條例之不足。

This article aims to analyze the criminal liability of the “competitive sports bribery” in Japan and intends to explore the possibility and necessity of legislation of the “competitive sports bribery” in Taiwan. The Author considers the Sports Lottery Issuance Act cannot punish the bribery about competitions, or transacting sports lottery and competition business in sports lottery. Also, according to the legislative system and the state of competition sports in Taiwan, the addition of the “competitive sports bribery” without the sports betting is not uncontroversial. Therefore, The Author argues that the “competitive sports bribery” must be amended within the Sports Lottery Issuance Act, and refer to the legislative model of the Act on Carrying Out, etc. Sports Promotion Vote in Japan, divide the “competitive sports bribery” into “competition bribery” and “official duties bribery,” to fill the legislative vacancies of the Sports Lottery Issuance Act.
