假釋社區監督與再犯之實證與建言

國內有關假釋制度之成效研究，一直以來囿於監所系統的研究，尤其在假釋再犯方面的研究，幾乎皆以靜態的服刑狀況、入獄前的家庭背景及就業情形為指標，鮮見社區處遇方面之探討。有關假釋出獄後的動態資料，反而在審核假釋申請案的考量上遭到旁落。本文立於社區處遇與假釋制度之結合為基礎，採取科學量化分析方法，期以本土社區矯正實證結果創構具備刑事法理與實務之專業性格，同時以顯著影響再犯的因子，設計一套得以適用於成年假釋再犯風險評估的工具，藉以補強過去相關文獻之隙漏，並為將來更深入的其他研究善盡拋磚引玉之效。

The effectiveness research of the parole system has been confined the prison system for a long time. In particular, the research on parole recidivism almost takes into account the static data about sentences, family background and employment situation before imprisonment. Rarely see the discussion of the community treatment aspects. Relatively, the dynamic data of released but ignored on the examination of the consideration of parole applications. This article is based on the combination of community treatment and parole system, than take a scientific quantitative analysis method, with the localization of community correction empirical results to create a criminal jurisprudence and practice of professional character. At the same time, the article designed a tool that could be applied to assessment the risk of adult parole recidivism with those significant impact factors, In order to reinforce the negligence parts of the past relevant literatures, and look forward to initiate other in-depth future research.
