社會福利國作為憲法基本原則，我國立法機關為保障我人民於正當使用合法藥物，卻不幸因此發生嚴重疾病、障礙甚致死亡結果，而訂立了「藥害救濟法」予以及時的救濟。然而，而實務的運作上仍有相當比例之受害者，被排除於救濟門外，以司法院釋字第767號所解釋的個案而言，申請人於疾病的治療過程中，因醫療的考量而使用系爭藥品卻因此產生了嚴重的耳聽力障礙及中度肢障；申請人據此提起了藥害救濟，卻遭審議委員會以該藥害屬藥害救濟法第13條第9款（下稱系爭條款）所規範「常見且可預期」之藥物不良反應，而否准之；申請人不服，窮盡一切的救濟程序未果，最終向大法官以系爭條款違反明確性、比例原則，侵害人民之生存權、健康權等由提起釋憲，藉此呼籲政府對疫苗藥害救濟能更寬鬆審查為妥善。
