Article 15 of the Simple Life Insurance Act:When applying for reinstatement of an insurance contract, the applicant and the insured are required to answer truthfully the insurer’s questions in writing. The duty of disclosure is different from the evidence of insurability. The duty of disclosure is based on the principle of utmost good faith and equivalence, whereas the evidence of insurability serves as a selection mechanism for risk management. This paper intends to focus on both and introduce the concept of the evidence of insurability into Simple Life Insurance. This could prevent proposers have opportunistic behavior when applying for reinstatement of an invalid insurance contract due to changes in health. |
