This study is an analysis of the criminal liabilities of the oil painting counterfeiter and the auctioneer. Any oil painting counterfeiter who forged, or fraudulently altered, an oil painting is liable to be punished for Offenses of Fraudulent and Offences of Forging Instruments or Seals under Articles 339 and 210 of the Criminal Code. The oil painting counterfeiter who infringed on the economic rights of another person by means of reproducing a work without authorization or infringed on the author's moral rights may be punished under Article 91 or 93 of the Copyright Act. Any auctioneer who was involved with the counterfeit oil painting and its sale may be punished for Offenses of Fraudulent under Article 339, and may be punished in accordance with the provisions relating to the forging or altering of documents, to making a false entry, or to causing a false entry to be made under Article 216 or Article 210 of the Criminal Code. They may also be punished under Article 91 or 93 of the Copyright Act if they infringed on the economic rights of another person by means of reproducing the work without authorization, or when they infringed on the author's moral rights. |
