The Ministry of the Interior in Taiwan is drafting a Real Estate Registration Code. The registration of condominiums is one of the disputed elements of the draft. In discussions, the Japanese legal system is frequently mentioned. However, few relevant papers are available in Taiwan. This article analyzes the registration system for buildings and condominiums in Japan and compares it with Taiwan's. In Japan, in the case that the building is registered as a condominium, its statutory common areas are not required to be registered separately. For the scope of a condominium unit, most Japanese scholars adopt the doctrine of the surface of the interior wall. This paper agrees with this doctrine but holds that the common area should be registered separately. |
