Cross-strait Peace Agreement: Theory, Challenges and Discussions

「和平協議」的建構在過去國際關係史上是從結束一個時代，以及建立一個新的霸權時代開始作為目的。冷戰時期，和平協議被當成是結束戰爭與控制衝突的政治工具，國際霸權為了維持兩極體系的權力平衡，必須以和平協議作為控制衝突升高的主要工具之一。後冷戰時期，和平協議被轉化成為是為了建造和平與推動全球治理的戰爭工具，霸權國家為了維持邊陲性國家內部的和平，他們把和平協議帶進更多的人道主義精神，所以冷戰以後的和平協議也被納入人道主義的議題，主要為了是制止邊陲國家內部的種族屠殺為目的。本文以國際和平協議的參考架構，作為分析兩岸簽署和平協議的範本，其中尤以停戰、自治與人道主義精神是最重要的思考框架，本文並依照此一框架列舉出兩岸和平協議的條文。作者認為兩岸的和平協議唯有在「停戰、自治與人道主義精神」的框架中進行簽署，才有可能為兩岸建造出和平的關係。

The establishment of peace agreement is on the purpose of which carries out one new era of hegemony, but old century had ended. During the Cold War, the peace agreement was designed politically to stop war or manage conflict. As we know, the peace agreement was employed to balance US and Soviet powers on the intention of avoiding escalation of conflict. After the Cold War, the peace agreement is transformed to an war tool in order to build peace and promote global governance. The supremacy countries mix humanitarian spirit into to counter genocide which happened in the rest of other countries. Based on the peace agreement, the analysis can be carried out in the study of the peace agreement between Cross-Strait; particularly, this agreement is in the centre of cease-fire, autonomous and humanitarian spirit, and besides the study will list every possible article of this peace agreement. The authors believe that cross-strait situation would come out peace on the principles of cease-fire, autonomous and humanitarian spirit. Expectedly, the Cross-Strait peace agreement will be signed and be ratified in the future.
