What is natural law?

本文的目的在簡要說明傳統自然法理論。自然法是指規制人類社會共同生活的倫理規範。自然法原則分為：原始自然法原則及派生自然法原則。原始自然法原則具有不變性及普遍性，而派生自然法原則因具體狀況的變動而改變。實證法立基於自然法。自然法向實證法提供依據及限制。實證法應具體化自然法原則，且不得牴觸自然法原則。

The purpose of this article is to illustrate briefly the traditional natural law theory. The words of“natural law”denote the moral principles which govern the social life of human society. The natural law principles can be categorized in primary principles and secondary principles. The primary principles are immutable and universal, while the secondary principles are variable according to concrete situations. Positive law is rooted in natural law. Natural law provides the basis and the limits for positive law. Positive law shall materialize the natural law principles and shall not contradict them.
