《閱微草堂筆記》中的冥判法律觀

Study on the Judgment Thought of Chinese Underword in “Yuewei Thatched Cottage Notes”

《閱微草堂筆記》是紀昀晚年力作，全書將近一千二百則故事，其中除包括大量的鬼、狐故事，也蘊含許多冥界司法審判的故事。紀昀用文學的筆法，去書寫清代司法以及禮教的衝突，頗值關注，是以本論文在序說中，從法律與文學的角度進行研究，略述既有研究以及紀昀的生平。在貳的部分，討論鬼神觀與冥判的關係，在參的部分，討論冥判中的訴訟觀，在肆的部分，討論冥判中的訴訟程序，在伍的部分，討論冥判中的性別關係，在陸的部分則總結前面各部分的論述，並提出結論。

Yuewei Thatched Cottage Notes, a miscellany that took Ji Yun ten years to complete during his leisure time at old age, encompasses nearly twelve hundred stories collected by Ji during his time in the Chinese Capital, Hebei, Xinjiang, and other places. In addition to the stories of ghosts and foxes, one of the main themes discussed in this erudite literary work also include the Judgment of the Chinese Underword. This research begins with an introduction comprising research motivation, purpose, method, scope, previous research, and Ji Yun Biography. The second chapter is a study of ghosts and Gods in the judgment of Chinese underword. The third chapter discusses litigation concept in the judgment of Chinese underword. The fourth chapter focuses on the judicial procedure in the judgment of Chinese underword. The fifth chapter is the discussion of gender relationship in the judgment of Chinese underword. Finally, the sixth chapter concludes the research based on the preceding five chapters.
