This project is aimed at examining the Draft of the Revised Korean Civil Code. The purpose of the project is twofold: exploring the newest changes made to the Korean Civil Code; and providing local academics with some information on the current development of, and understanding on, the Korean civil law. The Korean Civil Code has not been reformed since its promulgation in 1960. However, the Korean Ministry of Justice established a Civil Law Reform Committee and embarked on the revision of the code in 2009 in order to modernize and internationalize its Civil Code. The full-scale revision process finally came to an end in 2013. The revision encompasses the whole Code, i.e., the General Rules of Civil Law, Property Law, the Law of Obligations, and Family Law. The draft of the new Civil Code is considered to be a milestone in the Korean legal history. The Korean Civil Code has so far attracted little interests in Taiwan, thus research on Korean law has been relatively rare. However, Korea has recently become an indispensable jurisdiction in the comparative analysis of East Asian civil law. A study on the new draft of the Korean Civil Code is therefore worth conducting. The study will undoubtedly provide local lawyers with valuable information on Korean civil law, which can also be a basis for the future comparative research. That said, for reasons of space, the work only focuses on the General Rules of Civil Law and those of the Law of Obligations. |
