International Arbitration: Looking Behind and Looking Ahead

隨著國際經貿往來之頻繁，於投資貿易運作中，因文化經濟體制、商業慣例、政策規章等之差異，引起之爭端時常可見。因此於國際經貿之發展中，建立良好且完善之商務爭端解決機制，得以降低投資貿易不確定之風險，使投資人更具信心。近年來，具有迅速性、專業性、程序選擇之自由性、保密性與可執行性等優點之仲裁，更係受到當前國際商事爭端之當事人所重視。本文主要之目的係以我國仲裁相關法制之現代化為前提，就各國仲裁法治與運作現況進行觀察，釐清近年來國際仲裁之發展方向，盼得作為我國未來立法上之參考。

With increasing frequency of international trade, the disputes owing to cultures, business conventions, and national policies are common occurrences for the operators. In the development of international business, the integrity of dispute resolution mechanism could reduce the risk of investment, which leads to the rising of investor confidence. In recent years, the parties involved in international business affairs attach importance to arbitrations with speed of resolution, expertness, and confidentiality. This article generalizes the trend from foreign countries’ practical experiences of arbitrations, aiming to provide suggestions about the modernization of domestic arbitration law.
