The 1934 passed Criminal Code provided forgery offenses, however, it did not punish forgery of credit card. While credit card became a main noncash payment instrument, it was important to protect the transaction safety so the Legislation Yuan enacted Article 201-1 of Criminal Code in 2001. In applying Article 201-1, although charging and punishing each single forgery might result in overcriminalization, only one charge and punishment for multiple credit card fraud violations also infringe the society's feeling of justice. Therefore, it is necessary for the Legislation Yuan to add the applicable rule to distinguish one offense from offenses in credit card swindles. In this perspective, it may take 18 U.S.C. §1028(a)(7) as reference. |
