經濟部國營事業員工貪瀆與業務特性之研究

The Relationship between Employees' Corruption and Job Characteristics in the State-owned Enterprises of the Ministry of Economic Affairs

國營事業掌握龐大的公共資源，並扮演龐大資源的分配 者，所以國營事業發生不法弊端，常引起社會高度矚目。本 研究透過文獻及第一審法院判決之67個個案，將統計期間內 之經濟部國營事業貪瀆起訴案件，以分析、歸納等方式建立 基礎，進而找出經濟部國營事業員工貪瀆與業務特性之關聯 性，最後提出防制國營事業貪瀆弊案或不法違失之相關建 議。 整體而言，國營事業貪瀆犯罪仍以採購案件類型為主， 行為態樣主要為不違背職務收受賄賂罪和違背職務收受賄賂 罪，並且發現下列結果：一、單位採購金額、員工人員多寡 與不法弊端發生有正向影響。二、台水公司貪瀆犯罪者身分 趨於人事組織結構的兩端。三、審判機關對於台水公司和台 電公司的公共任務性認定有差異，影響判刑結果。本研究建 議：一、審判機關應檢討國營事業公共事務性認定標準。 二、國營事業機構各層首長應以身作則，樹立機關廉潔風 尚。三、建立標準作業程序後，容許適度經營彈性。四、採 購易滋弊端業務，應加強稽核監督。五、分眾實施廉政教 育，以提升廉潔意識。

State-owned enterprises hold a great amount of public resources while playing the role to distribute such resources. Therefore whenever any illegal abuse occurred within a stateowend enterprise, such incident normally attracted extremely high attention from the society. This study is based on reviewing relevant research papers and analyzing 67 cases of court decisions of the first instance court during the research period indicated herein. By studying relevant researches and the corruption prosecution cases in the enterprises owned by the Ministry of Economy Affairs, the correlation between the employees' corruption and job characteristics is found. Relevant recommendations to prevent corruption and malfeasance in state-owned enterprises are provided in this study accordingly.
