Since 2017, the United States has blocked the selection process for new members of the WTO Appellate Body by means of “consensus”. The existence of the Appellate Body is now facing a serious crisis. Amending the law to address US “concerns” or finding alternatives to the appeals process within the framework of the WTO system is worthy of discussion. In order to break the shackles of the United States, launching a voting system to select members of the Appellate Body is a considerably feasible solution which is not inconsistent with the current WTO rules. |
