第三人作為當事人主動加入訴訟之探討－－以我國民事訴訟法第54條規定為核心

The Study on a Third Party as the Person Concerned Intervention in Suit-Mainly on Taiwanese Civil Proceedings Act Article 54

我國現行民事訴訟法第54條之規定，可定位為「第三人主動加入（介入、引進）他人間訴訟」之訴訟形態。筆者以先前介紹之日本「獨立當事人參加訴訟」制度為基礎，於本文進一步探究與該制度其有淵源之我國民事訴訟法第54條之制度性質、訴訟架構、我國實務相關見解與訴訟運作可能涉及之問題，並提出對於我國現行規定之種種建議，且嘗試建構「兩面訴訟之複合體」（通說稱「三面訴訟」）訴訟架構之轉換機制，希冀藉此加深對我國民事訴訟法54條之認知，而有助於提升該訴訟之利用率。

Current Civil Proceedings Act Article 54 in Taiwan is placed as the suit form that 'a third party intervene in suit between another person' In this study, I consider a problem to be able to give in the case of a system property of Taiwan Civil Proceedings Act Article 54 with the relation with the system, suit structure, a Taiwanese business connection opinion and suit use more based on the 'independence person concerned intervention' system that I introduced of Japan first. In addition, I submitted various advice for the Taiwanese current rule and make an attempt to build a switch system of the suit structure which is 'complex of the both sides suit' (so-called 'lawsuit interesting three parties').Therefore, through deepening the recognition for Taiwanese Civil Proceedings Act Article 54, 1 hope to help improvement of the availability of the suit.
