This article takes the state redress lawsuit decisions made by the local courts in five cases about the Fukushima Daiichi nuclear power plant accident that occurred during the Great East Japan Earthquake, and studies the significance and problems of each judgment. The issue of this series of lawsuits is whether the non-exercise of the Minister of Economy, Trade and Industry's regulatory authority is an illegal act under the National Compensation Law for the prevention of the Fukushima Daiichi nuclear power plant accident. In this regard, this article makes a detailed analysis of how the decisions made by the five local courts judged about the issue, on the basis of a general review of the judgment framework. |
