網路因其無遠弗屆之特性,已成為日常民眾習於使用之交易工具。然而,因我國法制上對於透過網路交易之輸入行為並無專門之法律規定,從而透過網路交易完成之食品輸入行為究竟適法與否,即成實務上難以判斷之問題。對此,本文嘗試先透過民事法律關係之分析,初步掌握網路交易行為中各該當事人所扮演角色之權利義務與分工,並進而以行政法規之角度,篩選出依法應負行政法律責任之人,其能更精確界定各該行為人所從事輸入行為之適法性。
With its unprecedented characteristics, the internet has become a trading tool that people are accustomed to use. However, it is difficult to judge whether food import through online trading is legal or not since there is no specific legal requirement for the import accomplished through online trading in Taiwan's legal system. In this regard, this study attempts to analyze the rights, obligations, and duties assignment for each party involved in online trading through civil legal relationships, and to further clarify all individuals who are legally responsible for their behaviors. Thus, we might be more precise while defining the lawfulness of the import behaviors. |
