我國政府公共工程採購中,關於履約爭議解決機制有民事訴訟、仲裁、調解等三大處理機制,本文先從採購爭議之處理機制之基本架構為出發,介紹並比較三大採購履約爭議處理機制間之關係。而政府採購法第85條之1所規範之調解程序,如先調後仲,係工程採購所獨有之爭議處理機制,為本文所欲探討之重點。由於政府採購法第85條之1第3項規定:「採購申訴審議委員會辦理調解之程序及其效力,除本法有特別規定者外,準用民事訴訟法有關調解之規定。」因此本文將以民事訴訟法中之調解制度作為比較分析之對象,再就目前工程採購實務上運作之疑義進行評論,同時並針對2016年政府採購法修法進行通盤檢討。
In the procurement cases of public constructions in Taiwan, there are three dispute settlement mechanisms. There are civil litigation, arbitration and conciliation. This article introduces and compares three dispute settlement mechanisms on the performance of the procurement contract from the basic structure of the dispute settlement mechanism on the performance of the procurement contract. However, the conciliation procedures in Article 85 of the Government Procurement Act, such as “Ask for mediation first, applying for arbitration.” is the key point of this article. The third item of Article 85 of the Government Procurement Act: “The provisions of mediation of the Code of Civil Procedures shall apply mutatis mutandis to the procedure and effect of the mediation by CRBGP, unless otherwise provided in this Act.” Therefore, this article will use the civil procedure law mediation system as a comparative analysis of the object. Then comment to the current public constructions procurement practice. At the same time, review comprehensively for the Amendment of 2016 Government Procurement Act. |
