De-Globalization and an Approach to the Reshaping of Globalization

由於現行全球化制度存在失衡問題，全球化在促進經濟增長的同時，也帶來利益分配不均、異質性加大等全球化問題，逆全球化浪潮因此積聚成勢。逆全球化支持者認為國際法只是國家實現自身利益的工具，無法應對全球問題，摒棄全球化制度才是出路。但是，該路徑以國家自身利益為本位，通常會在國際社會層面引發諸多風險。國際法為全球化提供制度性框架，是重塑全球化最直接的路徑。國際法蘊含著國際社會的整體利益，通過它來完善全球化制度，可以有效應對全球化引發的問題，促進各方合作共贏，實現國際社會公平、全面的發展。 Globalization promotes the growth of wealth, and brings imbalanced distribution of benefits, intensity of inequality, erosion of social stability simultaneously, as to the issue of imbalance existed in the system of globalization, which results in the wave of anti-globalization. Proponents of anti-globalization argue that International Law (IL) is just an instrument to foster the interests of nations, so it could be violated for the purpose of national interest. However, this approach to deal with the issue is based on national interests, inducing a range of risks in the international community. IL provides globalization with an institutional framework, being a direct way to regulate globalization. Furthermore, IL accommodates the interests of the whole international community, and completes the system of globalization, so as to cope with the problems in connection with globalization. In this way, IL plays a significant role in facilitating the cooperation between states, achieving the equity in the international community and sound development of international society.
